This legal challenge presented by Mrs. B. Dugasse and Mrs. B. Pompe reflects significant concerns regarding the Chagossians’ rights and their historical grievances. The two Chagossians natives of Diego Garcia are contesting through a legal letter the legality and legitimacy of the treaty between the UK and Mauritius, which they believe perpetuates the historical injustices of colonialism by ignoring the rights and voices of the Chagossian people.

They have identified multiple violations of their rights as per the International Covenant on Civil and Political Rights (ICCPR). The letter requests the UN Human Rights Committee to bring about stopgap procedures, specifically advising Mauritius to suspend ratification of the 2025 Agreement until the Committee reviews the case. This is a critical step that could delay the effects of the Agreement while their claims are considered.

While the Committee’s decisions may not be enforceable by the law, they bear substantial moral and legal weight. The UK’s government has already acknowledged the 2019 International Court of Justice (ICJ) advisory opinion, which stated that the UK should end colonisation and return the islands to Mauritius, showing that international legal opinions can influence diplomatic and political decisions.

As this situation develops, it will be important to observe how the UK and Mauritius respond to the UN Committee’s decision and the broader implications for the Chagossian people’s rights and historical justice.
